03 THE PROCESS
STEP 2
WRITTEN OUTLINE
Submit Your Written Outline
In bullet point form each party outlines their 'case' and their objective. This enables the Mediator to identify the issues.
STEP 4
PRIVATE DISCUSSION
Held In Strict Confidence
The Mediator then has a private discussion with each party in turn to confidentially consider the strengths and weaknesses of each parties position.
STEP 6
AGREEMENT
Mutual Agreement And Settlement
When both parties have accepted and agreed on the solution it's time to close on the 'Deed Of Compromise'. Everything remains 'off the record' until this deed is signed. It then becomes fully binding and enforceable.
STEP 1
CONSENT
Mutual Consent From Both Parties
Both parties sign the Mediation Agreement which sets out the process, it is all 'off the record'.
STEP 3
FIRST MEETING
Make Your Opening Statement
Once we have taken the time to thoroughly read both written submissions, each party has the freedom to make their opening statement.
STEP 5
NEGOTIATION
What Are You Going To Do About It?
You need to consider what you really want and what may not be as important to you. Each party is encouraged to move toward a solution that each party can 'live with'.
